In Exodus 22:2, the construct singular form occurs in the clause about a thief found breaking in and struck dead. In Exodus 22:3, the absolute singular form occurs where the thief must make restitution and may be sold if he has nothing; the APB renders the final clause "he shall be sold for his theft."
In the Anselm Project Bible: The APB presents the legal setting through a thief breaking in in Exodus 22:2 and explicitly uses "theft" in its restitution clause in Exodus 22:3. The exact contribution of the term in Exodus 22:2 is less explicit.
